Patna Municipal Decided To Tighten Noose Around Builders Deviated From Approved Building Maps

The Patna Municipal Corporation (PMC) has decided to tighten the noose around builders who have deviated from the approved building maps while executing their project.

PMC board recently passed a proposal which will allow the corporation to impose additional fine over the existing one imposed in accordance with the building by-laws, in the event of any deviation from the approved building design. The fine would be five times the amount charged for deviation. "The sole intention behind introducing this additional fine is to discourage builders from making alterations in the approved maps as deviations cause lot of problems," said PMC commissioner Rana Awadhesh.

He said the new rule would be applicable to new buildings only and the old cases of design deviation would be dealt with in accordance with earlier rules. The deviation in building designs has become quite a common practice among builders as there were in-built provisions in the existing rules condoning deviations up to 20 per cent by charging a fine on the builders. "We have come across many cases where builders have introduced such deviations intentionally as the fine imposed was not substantial. Imposition of additional fine would certainly discourage the prevalent practice," the PMC commissioner said. Awadhesh also said plans were afoot to make provision of children's park and community hall a must in all the multi-storeyed buildings having 20 or more flats. Reacting to these new developments, co-ordinator of Bihar chapter of the Builders' Association of India (BAI) Narendra Kumar said the imposition of hefty fines for deviation in building designs is not a welcome step. "Instead of imposing it in all the cases of deviations, the PMC should first find out whether the deviation has been made wilfully or under compulsion," he said, adding, "Wilful deviation must be penalised." On the proposed rule for making children's park and community hall mandatory in buildings having 20 or more flats, he said a comprehensive rule should be made and it should be adhered to at least for a period of ten years. "Frequent changes in rules lead to loss to those builders who start their project when harsher rules are in place," Kumar added
