High Court Reserves Order On Acquittal Of Lalu, Rabri

Former union minister and noted lawyer Ram Jethmalani today strongly argued before the Patna High Court in favour of railway minister Lalu Prasad Yadav and his wife, former Chief Minister Rabri Devi opposing the Bihar government's appeal challenging their acquittal in the disproportionate assets (DA) case, an off-shoot of the multi-crore fodder scam.

On its part, the Patna High Court subsequently reserved its order on the maintainability of the Bihar government petition challenging the acquittal of Lalu Prasad and Rabri Devi.

Arguing against the state government's appeal, Jethmalani contended that since the case was probed by CBI, the agency and the Central government alone were competent to challenge the CBI court verdict. "The NDA government's action to appeal against the acquittal is politically motivated," he said.

To substantiate his stand, Jethmalani pointed out that the right of appeal is not the right of procedural law but right of substantive law." Since the case was investigated by the CBI, which functions under the Delhi Special Police Establishment Act, either the agency or the Centre and not the state government are the competent authorities to file an appeal," he said.

Justice Ramesh Kumar Datta reserved his order today on the petition filed by the state government on February 19 against Lalu and Rabri's acquittal by special CBI judge Muni Lal Paswan on December 18 last year after hearing their counsel Ram Jethmalani, solicitor general G. Vahanvati and state counsel and senior Supreme Court advocate Surendra Singh.

The state government had appealed against the CBI court verdict.
