Patna Law College, A Constituent Unit Of Patna University (PU) Faces Derecognition
Patna Law College, a constituent unit of Patna University (PU) and one of the oldest institutions of legal education in the country, is once again threatened with derecognition of its degrees. The college has only two teachers for the last one year, violating the Bar Council of India (BCI) regulations.
Ever since this college was derecognized by the BCI about a decade back owing to insufficient strength of teachers, PU has been appointing full-time and part-time teachers on an ad-hoc basis for a period of six months. Even as BCI somehow restored back its affiliation to the college following temporary appointments and strenuous efforts made by PU, it has been keeping a close eye on maintenance of strength of teachers in the college. Surprisingly enough, not even ad-hoc appointment of any teacher has been made in the college during the last one year to maintain the required teaching strength. Disposing of a writ petition filed by some ad-hoc teachers of the college in November last year, Patna High Court (HC) had directed the chancellor, the state government and the vice-chancellor of PU to discharge their obligations for constitution of the university selection committee within one month and make appointment of full-time and part-time law teachers against vacant posts within six months.
Consequently, the BCI, which had been directed by the HC to ensure strict compliance of its directions, also directed PU to file the replies before the council by way of an affidavit intimating about the compliance of the directions. Any default in carrying out the directions would be viewed seriously, the BCI warned. More than six months have already passed after the issuance of the HC directions, but the appointments are yet to be made. PU registrar Vibhas Kumar Yadav, told TOI that all the 29 sanctioned posts, including 14 part-time lecturers, have been advertised, but the appointments have been delayed owing to the ongoing indefinite strike by non-teaching staff of the university. He, however, claimed that the process of appointment of law teachers would be expedited soon. The relevant statutes for appointment of teachers have already been framed, he added. Meanwhile, taking serious note of the practice of making ad-hoc appointment of law teachers in PU for the last one decade, Human Rights Protection Foundation national general secretary Vivekanand Mishra has urged the state government and PU authorities to regularise the services of all the teachers serving in Patna Law College on an ad-hoc basis for the last one decade.
