Corrupt Bihar Babus To Lose Property Now
There is bad news for corrupt babus, at least in Bihar. With the Centre clearing its Special Courts Bill, 2009, Bihar becomes the first and the only state in the country to be equipped with a law to rein in corruption at high places. The development is expected to facilitate the state government's efforts to nail corrupt officials.
Under the law, officers and employees, if found guilty by the special courts, could end up losing their properties, both moveable and immovable, to the state government, which would then be free to open schools, hospitals and other offices in such establishments. The law is expected to emerge as a major deterrent for the babus in their efforts to amass wealth through illegal means. In keeping with its endeavour to bring the unbridled run of corruption in government offices under a leash, the Nitish Kumar government had early last year passed the Bihar Special Courts Bill. It had been lying with the UPA government for its green signal for over a year, provoking the state chief minister to accuse the Centre of putting roadblocks in its efforts to fight the menace. For the JD(U)-BJP alliance, the enactment of the anti-corruption law is a major achievement, and is expected to bolster its campaign to re-capture power in the state when it faces assembly later this year. With the Centre now granting its approval to the Bill, the state officialdom has been shaken from its ``no-one-touch-us'' complacency. All IAS and IPS officials, besides officials of the state public service commission, will be covered by the law.
The state government will now be empowered to set up special courts to hear all corruption-related cases. With the consent of the Patna High Court, district and additional district and session judges could be appointed to preside over these courts. They will be empowered to punish public servants found guilty of indulging in corrupt practices and also to confiscate their properties. The fate of the cases brought to these courts will be time-barred, as their hearing will have to be completed within a year of the case coming to light. The orders passed by these special courts can only be challenged in the Patna High Court, that too within 30 days of the conviction of an accused. The latter, if it wants, could transfer such review cases to another special court. Officials held guilty by the courts will have to pay a heavy price to reclaim their properties -- they will have to pay their market price to re-establish their ownership.
